In a development that has reignited the long-standing feud between the American executive and the intelligence community, a federal grand jury has indicted former FBI Director James Comey on charges of threatening the life of President Donald Trump. The indictment, returned on Tuesday, in the Eastern District of North Carolina, marks the second time the Trump administration’s Justice Department has sought to prosecute the former bureau chief.
‘Shell Game’
The criminal charges—two counts including knowingly and willfully making a threat to take the life of the President—stem from an Instagram post shared by Comey on May 15, 2025. The image depicted a “cool shell formation" encountered during a beach walk, with seashells arranged to form the numbers “86 47".
Federal prosecutors argue that the message was a coded threat. In slang, “86" is often used to mean “eject", “remove", or “kill", while “47" refers to Donald Trump’s status as the 47th President of the United States. The indictment states that a “reasonable recipient familiar with the circumstances" would interpret the image as a “serious expression of an intent to do harm" to the President. Following the post, the Secret Service interviewed Comey, who subsequently deleted the image and clarified that he opposed violence and had simply seen the shells as a “political message".
A Pattern of Legal Confrontation
Acting Attorney General Todd Blanche and FBI Director Kash Patel defended the move during a press conference, asserting that “threatening the life of the President will never be tolerated". This indictment follows a previous legal attempt to prosecute Comey in late 2025 on charges of lying to Congress, which was ultimately dismissed by a federal judge after the lead prosecutor was found to have been unlawfully appointed.

Political and Legal Fallout
The case has been assigned to Judge Louise Wood Flanagan, a George W Bush appointee. Legal experts have already flagged the high threshold required to prove “intent" in threat-based cases, noting that the Justice Department may struggle to satisfy a jury that a photo of seashells constitutes a viable criminal threat beyond a reasonable doubt.
Meanwhile, civil liberties groups, including the ACLU, have condemned the indictment, labelling it an abuse of power and an attempt to “silence and intimidate" political critics. As the legal proceedings begin, the case is set to become a focal point in the debate over the weaponisation of the US justice system.
